Got a Defective Product or Bad Service? Filing a Consumer Complaint Without a Lawyer

What Counts as a Consumer Complaint

Which Commission Hears Your Case

The Act sets up three levels based on how much money you are claiming, not where you live or where the seller is based. Note that the jurisdiction limits below reflect the Consumer Protection (Jurisdiction of the District Commission, the State Commission and the National Commission) Rules, 2021, which superseded the original thresholds set out in the base Act and remain in force.

- District Consumer Disputes Redressal Commission: claims up to Rs 50 lakh

- State Consumer Disputes Redressal Commission: claims above Rs 50 lakh up to Rs 2 crore

- National Consumer Disputes Redressal Commission (NCDRC): claims above Rs 2 crore

Most individual disputes, a defective washing machine, a botched wedding photography contract, a rejected health insurance claim, will sit comfortably in the District Commission. You file where you live, where you work, or where the seller operates, whichever is convenient for you. That flexibility alone removes a big chunk of the hassle people associate with old-style civil litigation.

Filing Through e-daakhil, Without Stepping Into a Court

The government built e-daakhil (edaakhil.nic.in) specifically so people would not need a lawyer or a trip to a district office. You register with your email and phone, fill in the complaint form with details of the transaction and the deficiency, upload your bills, warranty cards, screenshots of chats, or photos of the defect, pay a small filing fee based on your claim value, and submit. The portal uses the same current 50 lakh and 2 crore thresholds noted above to route your complaint to the right commission. It generates a case number and you can track hearing dates and orders from your phone.

Call 1915 Before You File Anything

The National Consumer Helpline at 1915 (also reachable via the UMANG app and the NCH website) is the government's first line of defence before litigation. Trained counsellors log your complaint and often reach out to the company directly to mediate a resolution, refund, replacement, or an apology with compensation, without you ever entering a commission. A large share of complaints get resolved at this stage alone. Even if it does not settle, having a formal NCH complaint number strengthens your later filing.

Timelines and What You Actually Get

Once you file, the opposite party typically gets 30 days to respond, extendable to 45 days in specific circumstances. The law directs commissions to aim for disposal within three to five months depending on whether goods need lab testing, though real-world timelines vary by state and case backlog, so treat this as a target rather than a guarantee.

If you win, Section 39 (and the equivalent provisions applied to State and National Commission proceedings) gives the commission wide powers: it can order removal of the defect, replacement of the product, a full refund, compensation for financial loss or mental agony, discontinuation of the unfair practice, and costs of litigation.
